Rule 25
Procedure for Accrediting Foreign Certification Bodies

(1) Any certifying body that wishes to work as a certifying body in Nepal and is licensed to perform certification in accordance with the laws of a foreign country may submit an application to the controller by attaching the following documents and details to the controller stating that it wishes to work as a certification body in Nepal:-
(a) Certified copy of the license obtained to act as a certification body abroad,
(b) statement of paid-up capital or equity,
(c) Evidence and details showing that the conditions and qualifications to be fulfilled by the certifying body in accordance with the Act and these regulations,
(d) such other particulars as may be required by the Controller.
(2) From the documents and details received with the application as per sub-rule (1), if the controller deems it appropriate to recognize such foreign body to work as a certifying body, he shall also propose the conditions to be followed and submit it to the Government of Nepal for approval.
(3) If submitted to the Government of Nepal for approval in accordance with sub-rule (2), the Government of Nepal may give approval to act as a certifying body if there is any addition or modification to the conditions proposed by the Controller.
(4) If approval is received from the Government of Nepal in accordance with sub-rule (3), such foreign entity shall work as an open certifying body by obtaining a bank guarantee and the fees required for granting a license to act as a certifying body in accordance with this regulation. The notice of approval to do so shall be published in the Nepal Gazette.
(5) In case of not complying with the conditions specified in the notice as per sub-rule (4) or in case of acting contrary to the Act or these regulations, the controller shall cancel the recognition obtained by the certifying body after obtaining the approval of the Government of Nepal and publish the notice in the Nepal Gazette.
